TERMS AND CONDITIONS OF THE ONLINE STORE pherostrong.eu
The online store available at www.pherostrong.eu is operated by MEDICA-GROUP SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, headquartered at ul. Mikołaja Reja 43/1, 76-200 Słupsk, registered in the National Court Register of Entrepreneurs maintained by the District Court Gdańsk-North in Gdańsk, 8th Commercial Division of the National Court Register under KRS number: 0000548311, NIP: 8393178436, REGON: 3610350590, share capital: PLN 5,000.00 fully paid, hereinafter referred to as the "Seller."

§ 1 GENERAL PROVISIONS
Definitions:
TERMS AND CONDITIONS – these regulations.
CUSTOMER – any individual, legal person, or organizational unit without legal personality but with legal capacity, placing an Order under the conditions defined herein.
ENTREPRENEUR WITH CONSUMER RIGHTS – an individual conducting business activity (registered in CEIDG), placing an order not directly related to their professional activity. This status applies only to customers with delivery addresses or headquarters in Poland.
CONSUMER – a natural person using the Online Store for purposes not directly related to their business or professional activity.
PRODUCT – a movable item offered in the Online Store that is the subject of the Sales Agreement.
SALES AGREEMENT – an agreement for the sale of goods as defined in the Civil Code, concluded between the Seller and the Customer through the Store's website.
ONLINE STORE (STORE) – the website available at www.pherostrong.eu where Customers can place Orders.
ORDER – the Customer's declaration of intent that clearly specifies the type and quantity of Products and is directly aimed at concluding a Sales Agreement.
The Store enables the sale of products currently in stock and allows Customers to place Orders via its website. Customers can browse the product selection without registering. Orders may be placed either through customer registration and login or by correctly filling out the order form without logging in.
Each Customer placing an order must read and accept these Terms and Conditions.
§ 2 TECHNICAL REQUIREMENTS FOR ORDER PLACEMENT
To use the Store, the following technical requirements must be met:
Internet connection,
Properly configured web browser,
Active and properly configured email account,
Enabled Cookies and JavaScript,
PDF file reader.
If these requirements are not met, the Store does not guarantee full service functionality.
Customers are prohibited from submitting unlawful content in reviews or otherwise.
Customers can subscribe to the newsletter to receive updates on products and services. Subscription requires providing an email address and consenting to the processing of personal data. Customers may unsubscribe at any time via email or the unsubscribe link in the newsletter.
§ 3 REGISTRATION
Registration is free and optional.
To register, the Customer must complete the registration form with required identification details (name, surname, email, and password), accept the Terms and Conditions, and consent to the processing of personal data. Confirmation of registration is sent via email. Upon receipt of this confirmation, an account agreement is formed.
Login occurs using the registration credentials. To delete the account, the Customer must send a deletion request via email. If an order is in progress, deletion is postponed until the order is fulfilled.
Orders can also be placed without registration by filling out the required form each time.
§ 4 ORDERS
Information about products on the website constitutes an invitation to conclude a contract under Article 71 of the Civil Code.
The Order process begins on the product page with details on availability, delivery time, price, and payment and delivery options. The Order is finalized by clicking "order and pay," which also confirms the Customer has read and accepted the Terms and Conditions.
The Store will confirm order acceptance via email. If the Customer leaves the site before clicking "order and pay," no contract is formed.
Customers making purchases as businesses must provide a VAT ID; otherwise, the purchase is treated as a Consumer transaction.
If some Products are unavailable, the Store will notify the Customer within 14 days. The Customer may choose to:
Accept partial fulfillment (only available items),
Cancel the entire Order.
If the Customer cancels, the Store will refund any payments.
§ 5 PRODUCT PRICES AND PAYMENT METHODS
Prices listed include VAT (where applicable) and exclude delivery costs. Discounts may apply and will be shown in the order summary.
Delivery options:
Courier (InPost, Pocztex, GLS, UPS),
InPost Parcel Locker,
Polish Post.
Shipping costs depend on delivery method and are shown during the order process.
Payment options:
Bank transfer,
PayPal (via PAYPAL POLSKA Sp. z o.o.),
PayU (via PayU S.A.).
If payment is not received within 14 days (except for cash on delivery), the Order is cancelled. A reminder is sent after 3 business days.
Orders are delivered as confirmed, no later than 30 days after contract formation.
§ 6 COMPLAINTS
The Store is obliged to deliver goods without defects and fulfill services per contract.
The Store is liable for product compliance for 2 years from purchase.
Complaints may be submitted via email or in writing. Customers must specify the issue and desired outcome (repair or replacement).
In the case of justified complaints, the Customer bears no return shipping costs.
If the Store refuses to rectify the issue or fails to do so in a reasonable time, the Customer may demand a price reduction or withdraw from the contract.
If the contract is withdrawn, the Store will refund all payments within 14 days.
Consumers can use alternative dispute resolution methods (mediation, arbitration). More info is available at www.uokik.gov.pl or via the EU platform at http://ec.europa.eu/consumers/odr.
§ 7 RIGHT TO WITHDRAW FROM THE CONTRACT
Consumers and Entrepreneurs with Consumer Rights may withdraw within 14 days of receiving the goods. They must submit a withdrawal statement (template available in the attachment) and return the goods.
Goods must be returned in unchanged, complete condition without usage signs unless necessary for examination. The Store may reject or reduce refunds for used or incomplete returns.
The right of withdrawal does not apply to:
Custom-made or personalized items,
Perishable items,
Sealed goods unfit for return once opened for health/hygiene reasons,
Goods inseparably connected with other items.
Goods must be returned within 14 days of withdrawal to: ul. Mikołaja Reja 43/1, 76-200 Słupsk. Return shipping costs are borne by the Customer.
Refunds are made within 14 days of receiving the withdrawal statement. Payments are refunded to the original payment method unless otherwise instructed by the Customer.
The Store may withhold the refund until it receives the returned goods or proof of return.
§ 8 PERSONAL DATA PROTECTION
Provisions on data protection are included in the Store's Privacy and Cookie Policy available on the website.
§ 9 FINAL PROVISIONS
Each sale is accompanied by a VAT invoice or other receipt in accordance with tax regulations. Invoices may be sent electronically. Acceptance of the Terms also constitutes consent to receive electronic invoices.
Polish law applies. Disputes are settled by the competent court for the Seller’s location unless otherwise specified by civil procedure regulations for Consumers.
The Seller reserves the right to amend the Terms. Registered Customers will be notified via email and may terminate the contract within 14 days. Amendments take effect 14 days after notification. Orders placed before the effective date are processed under the Terms valid at the time of ordering.
